SUPPLIER

  1. This website is operated by Sunshine Caravans Pty Ltd (ABN 99 125 720 283). Goods advertised and sold on this website are supplied by Gawler Caravan Centre (ABN 24 007 643 843). References to "we", "us" or "our" in these Terms and Conditions refer to Gawler Caravan Centre as the supplier of the goods, unless the context requires otherwise.

PRICES

  1. Prices on this website, unless otherwise stated, are expressed in Australian dollars, include Goods & Services Tax (GST) (if applicable) and are based on our current prices, which will vary from time to time. Product pricing may be different for purchases made in-store.

PAYMENT

  1. The whole of the invoiced price must be paid before delivery of the order. Payment must be made in Australian dollars.

DELIVERY

  1. We only deliver to Australian destinations. We will take all reasonable steps to ensure that goods leave our store within two (2) business days of order confirmation. Where Express Postage is selected and paid for, we will generally have the goods leave our store within one (1) business day of order confirmation. Delivery times to your address will vary depending on your location and the delivery method selected, and are estimates only.

RETURNS (CHANGE OF MIND)

  1. This clause applies to change-of-mind returns only. It does not limit or affect your rights under the Australian Consumer Law in relation to faulty, damaged, or misdescribed goods — see the "Your Consumer Guarantees" clause below.

5.1 We are not obliged to accept a change-of-mind return, but where we agree to do so: (a) the return must be authorised by us in advance; (b) you must pay all shipping charges associated with the return; (c) the item must be returned within seven (7) days of the date of delivery; (d) the item must be in original, saleable condition; and (e) we may charge a reasonable restocking fee, which will be disclosed to you before the return is finalised.

YOUR CONSUMER GUARANTEES

6.1 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

6.2 If there is a problem with your order, please contact us and we will assess your claim in accordance with your rights under the ACL. We will not require you to demonstrate a "major problem" before considering your claim — the remedy available to you (repair, replacement, refund, or compensation) will depend on the nature and severity of the fault, as determined under the ACL.

6.3 To the extent permitted by law, and subject to the guarantees referred to above, our liability for loss arising from the supply of goods or services is limited, at our option, to the replacement or repair of the goods, the supply of equivalent goods or services, or payment of the cost of doing so. Nothing in these Terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded, restricted, or modified under the ACL or other applicable law.

CANCELLATION OF TRANSACTIONS

  1. You may cancel an order at any time before payment is made. Please choose carefully before finalising your purchase. Once payment has been made, cancellation is subject to our Returns clause above and your rights under the ACL.

MAKING A CLAIM

8.1 If you have a concern or believe there is a problem with goods or services supplied, please contact us as soon as reasonably possible so we can investigate and resolve the matter. Prompt notice helps us assess and respond to your claim efficiently.

8.2 Nothing in this clause limits or excludes any right or remedy you have under the Australian Consumer Law, including the timeframe within which you may bring a claim, which depends on the nature of the goods and the type of failure involved and is not fixed by these Terms.

REPRESENTATIONS

9.1 Statements or representations regarding performance, measurements, power consumption, and similar matters — whether contained in drawings, catalogues, advertisements, or otherwise — are indicative only and do not form part of this contract unless expressly confirmed by us in writing.

9.2 This agreement, together with any attachments, constitutes the entire agreement between us and replaces all prior discussions, agreements, or understandings between the parties, except for any rights or guarantees you have under the Australian Consumer Law, which continue to apply.

9.3 No variation of this contract is binding unless made in writing and agreed by us.

GOVERNING LAW AND JURISDICTION

  1. This agreement, and any claims arising out of or related to it, is governed by the laws of the State of South Australia. The parties submit to the non-exclusive jurisdiction of the courts of South Australia and the courts of appeal from them, without limiting either party's right to bring proceedings in another jurisdiction where required by law.
